Purpose: Chapter 00 – Organization and Governance provide guidance on the authority and ownership of ɫ Regulations. Further, the chapter outlines guidelines for the regulation, development, review, and approval of ɫ Regulations.


01 General  

ɫ Regulations (“ɫ System Regulations”) serve as systemwide regulatory requirements and are established to communicate, implement, and support governance and operational efficiency for the organization.

ɫ System Regulations adhere to the ɫ Board of Regents’ Rules (“Regents’ Rules”) and administer direction from the chancellor by providing the operating requirements and procedures necessary for their administration and reporting. These regulations may include interpretations or guidance to ensure uniform application and consistent compliance across the ɫ System.

ɫ System Regulations may also be adopted to promote operational efficiency, establish best practices, and provide systemwide guidance on matters of institutional management not specifically addressed in the Regents’ Rules or by university policy. In addition, these regulations may be used to ensure consistent compliance with fiscal, academic, research, employment, and other administrative standards required by federal or state law or by external regulatory authorities.

Unless otherwise specified, ɫ System Regulations apply to the ɫ System, its component institutions, and their respective employees.

ɫ System Regulations are subordinate to all applicable federal and state laws, rules, and regulations. ɫ System Regulations must also conform to the ɫ Board of Regents’ Rules (“Regents’ Rules”). In the event of a conflict, the Regents’ Rules supersede ɫ System Regulations. Similarly, ɫ System Regulations supersede component institution policies. 

02 Review  

This regulation will be reviewed in September every three years, or as needed, by the Office of the Chancellor and the Office of the Board of Regents.

03 Definitions  

Unless otherwise defined elsewhere, the words and phrases used in a ɫ System Regulation should hold their ordinary definition and meaning as applied in daily usage. Words and phrases that are specific to the ɫ System should utilize the assigned meaning as defined in Chapter 00 of The Rules and Regulations of the Board of Regents of the ɫ.   

04 Authority and Approval

a. The chancellor, as the chief executive officer of the ɫ System, has the authority to establish and approve ɫ System Regulations and may delegate that authority as appropriate.    

b. Each ɫ System Regulation will be assigned to a functional area within ɫ System Administration and the corresponding administrative office. The senior administrative leader overseeing that functional area is responsible for the regulation and accountable for its development, maintenance, and implementation. The office responsible is considered the subject matter authority for the issues addressed in the regulation.

c. The office responsible shall coordinate the development or revision of a regulation and may consult with appropriate ɫ System Administration offices, component institution leadership, and other relevant stakeholders to ensure the regulation reflects systemwide operational needs and requirements.

d. Prior to approval and publication, each ɫ System regulation must be presented to the chancellor’s executive leadership team for awareness and the opportunity to provide input.

e. Final approval of ɫ System Regulations rests with the chancellor or the chancellor’s designee.

f. In the absence of a ɫ System Regulation, policy direction and applicable guidance will be taken from the Regents’ Rules and/or a component institution’s operating policies and procedures. 

05 Style  

a. ɫ System Regulations will be published and maintained on the ɫ System website. 

b. Each ɫ System Regulation must include a Purpose section that summarizes intent and information covered by the regulation.     

c. Each ɫ System Regulation must include a Review section that identifies a process for reviewing and updating the regulation. The process should identify the office responsible for initiating the review, the frequency of review, relevant reviewers, and the final approving office. 

d. Each ɫ System Regulation must include a Definitions section for the words and phrases that may have a specific meaning in the context of the regulation. 

e. Each ɫ System Regulation should include an intended Audience section that identifies those to whom the regulation applies, if application is not systemwide.   

f. Each ɫ System Regulation should include a Relevant Statutes and Polices section referencing the statutes, directives, and reporting requirements relevant to the regulation.
